Donna Byrne, 53, was recently arrested for DUI after allegedly riding a horse drunk in a busy highway in the middle of the afternoon. Section 316.193, Florida Statutes, prohibits a person from being "in actual physical control of a vehicle" while intoxicated. The statute does not specify whether a horse would qualify as a vehicle. The State later charged Byrne with animal abandonment, disorderly intoxication, and culpable negligence. Police seized Byrne's horse and took it to the Polk County Sheriff’s Animal Control livestock facility.
